General Terms and Conditions for the Purchase of Entrance Tickets for Events of AFAG Messen und Ausstellungen GmbH via the Internet

1 Subject matter of the contract

These general terms and conditions regulate the legal relationship between AFAG Messen und Ausstellungen GmbH, Johann-Höllfritsch-Straße 20-22, 90530 Wendelstein, Germany (Commercial Register (HRB) 651, Local Court (Amtsgericht) Nuremberg) - hereinafter referred to as "AFAG" - and its visitors with regard to ordering and purchasing tickets for AFAG events.

These general terms and conditions are addressed both to consumers within the meaning of section 13 German Civil Code (BGB) and to entrepreneurs within the meaning of section 14 German Civil Code. A consumer is any natural person who enters into a legal transaction for a purpose that can be attributed neither to his/her commercial nor to his/her self-employed professional activity. An entrepreneur is a natural or legal person or a legal business partnership who, when concluding a legal transaction, acts in the execution of his/her commercial or self-employed professional activity. Trade visitors to trade fairs are entrepreneurs within the meaning of this regulation.

Unless otherwise indicated below, the regulations apply to both consumers and entrepreneurs.

By placing an order, the visitor accepts these general terms and conditions as a binding contractual basis.

2. Conclusion of the contract

With online ticket orders, the visitor makes a binding offer to conclude a contract. The AFAG accepts the contract offer of the visitor, where applicable, by sending him/her confirmation by email.

The contract comes into effect as soon as the visitor has completed the order process and the confirmation email has been received by the visitor, but at the latest with receipt or retrieval of the e-ticket.

At trade fairs, AFAG reserves the right to exclusively sell entrance tickets to trade visitors (entrepreneurs) and to check the status of trade visitors appropriately.

3. Payment

Payments are usually made by credit card or PayPal. In individual cases, AFAG may permit a different method of payment (e.g. direct debit or after receipt of invoice). A corresponding note on the payment methods permitted for the respective event can be found in the online forms for ordering the e-ticket.

4. Personalisation

The ticket purchased by the visitor entitles the person named on the ticket to attend the event. The ticket may not be resold or transferred in any other way to third parties without the prior consent of AFAG.

5. Liability

Warranty and liability shall be governed by the statutory provisions, unless otherwise provided for below.

AFAG is only liable for damages other than those resulting from injury to life, body and health if these are based on intentional or grossly negligent action or on culpable violation of an essential contractual obligation, the fulfilment of which makes the proper execution of the contract possible in the first place by AFAG or one of its vicarious agents and on whose compliance the visitor may regularly rely on. If an essential contractual obligation is negligently violated, the liability of AFAG is limited to contract-typical, foreseeable damage. Any further liability for damages is excluded.

6. Right of revocation

The right of revocation described in the following paragraph applies for consumers. There is also no right of revocation for consumers for the purchase of e-tickets for leisure activities for which a specific date or period is planned, such as show, concert or evening events.

You are entitled to revoke this contract within fourteen days without giving reasons. The revocation period is fourteen days from the date of conclusion of the contract. In order to exercise your right of revocation, you have to inform us,

in an unequivocal statement (e.g. a letter, fax or email sent by post) about your decision to revoke this contract. You can use the attached model revocation form (see annex), however, this is not mandatory. In order to comply with the revocation period, it is sufficient that you send the notice of the exercise of the right of revocation before the expiry of the revocation period.

8. Return/cancellation

Apart from the aforementioned right of revocation, there is no right to return or cancel e-tickets in favour of the visitor, unless the event is cancelled or postponed. In this case, the visitor is entitled to a refund of the purchase price paid for the e-ticket.

9. Copyrights

All copyrights are reserved. The contents of this site may not be copied to be passed on, modified or used on other websites for business or commercial purposes.

10. Data protection

We generally only collect and use personal data of our users insofar as this is necessary to provide a functional website as well as our contents and services.

11. Final provisions

The sole place of jurisdiction for entrepreneurs, legal entities under public law and special funds under public law shall be Nuremberg, where legally permissible. However, in these cases, AFAG is also entitled to sue at the usual place of jurisdiction of the other party.

German law shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

If individual clauses of these general terms and conditions should be or become invalid, this shall not affect the validity of the remainder of the contract. Any provision that is not included or invalid shall be replaced in this case by the relevant statutory provision.
